When I was in law school my professor installed a deep and abiding respect for the 1st Amendment. I strongly believe the courts of our nation should not shut down political speech before the words are uttered except only under the most extreme circumstances.
People with resources will always have access to power. Some have only their voices. At times ideas expressed and interpreted by others appear to be very different from our own. Sometimes these people can have something important to say that involves the common good.
One case I worked on was heard by the California Supreme Court. (
40 Cal. 4th 1141) The staff editorials of the Orange County Register and Los Angeles Times supported our position regarding objections to prior restraint. A similar case was heard in front of the U.S. Supreme Court. (
544 U.S. 734)
After I was interviewed on the topic on a local radio show, it became clear to me that the right to speak freely on political issues must be protected must be protected, including big statements based on loosely connected thoughts,. It doesn’t matter what radio station you chose, as I trust the “market place of ideas” to sort things out.
